Terms of Use

1. Publisher

Foxy Family is published by Leadovation SAS, a simplified joint-stock company with a share capital of 1,000 euros, registered with the Versailles Trade and Companies Register under number 539 777 565, with its registered office at 16 rue de la Porte de Fourqueux, 78112 Saint-Germain-en-Laye, France. 2. Purpose

These terms govern the use of the Foxy Family application and service, a family organization tool (tasks, shopping lists, health tracking, rewards, messages, and household information), available on the web and through the mobile apps.

3. Account and eligibility

Creating a household is reserved for an adult, who is responsible for their household and the members they add, including children's profiles. You are responsible for keeping your credentials confidential.

4. Subscription, prices, and renewal

The price charged on each platform (web via Stripe, App Store, Google Play) is the one displayed at the time of purchase on that platform. A subscription taken on any of these platforms is valid on all of them (the household, not the device). The subscription renews automatically until canceled. Management and cancellation are done where the subscription was taken. Prices include applicable taxes where required.

5. Right of withdrawal

Foxy Family is a digital service whose performance begins immediately upon subscription. By subscribing, you expressly request the immediate start of the service's performance and acknowledge that you thereby waive your 14-day withdrawal right otherwise available for distance contracts under French consumer law.

6. Acceptable use

You agree not to use the service for unlawful purposes, not to attempt to compromise its security, and not to post unlawful content. We may suspend an account in the event of a breach.

7. Availability and offline use

The service is designed to work offline and then synchronize. We strive to keep the service available but do not guarantee uninterrupted or error-free operation.

8. Health: not medical advice

The health and medication tracking features of Foxy Family are organizational aids. Foxy Family does not replace medical advice. You remain solely responsible for the actual management of treatments.

9. Intellectual property

The service, its trademarks, and its content (other than content you create) are owned by Leadovation SAS. You keep your rights in the content you create and grant us the right to host and process it in order to provide the service to you.

10. Personal data

The processing of your data is described in our Privacy Policy.

11. Liability

To the extent permitted by law, the liability of Leadovation SAS is limited to direct and foreseeable damages resulting from the use of the service. The total amount of any compensation payable by Leadovation SAS shall not exceed the amounts actually paid by the user for the subscription during the twelve (12) months preceding the event giving rise to the claim. Nothing in these terms excludes or limits the liability of Leadovation SAS where the law prohibits it (in particular willful misconduct, gross negligence, or harm to life or physical integrity), nor limits the rights the law grants to the user as a consumer.

12. Termination

You may stop using the service and delete your household at any time. We may terminate or suspend access in the event of a breach of these terms.

13. Changes

We may amend these terms. In case of a significant change, we will inform you.

14. Governing law and disputes

These terms are governed by French law. In the event of a dispute, please contact us first at support@leadovation.fr. In accordance with the provisions of the French Consumer Code on consumer dispute mediation, after contacting us and if our reply does not satisfy you, you may use a consumer mediation procedure free of charge with:

Failing an amicable resolution, any dispute will be brought before the competent French courts.
